ARTICLE 3: APPLICABILITY OF THE GENERAL TERMS AND CONDITIONS
These general terms and conditions apply to every offer made by the merchant and to every distance contract concluded between a merchant and a consumer.
Before a distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, the merchant will indicate, before the contract is concluded, where the general terms and conditions can be consulted and that they will be sent free of charge to the consumer upon request.
If the contract is concluded electronically, the consumer will receive these general terms and conditions in an electronic format that allows them to be stored and consulted at a later date on a durable medium. If this is not possible, the merchant will specify where these general terms and conditions can be consulted online and that a copy will be sent free of charge upon request.
Where specific product or service conditions apply in addition to these general terms and conditions, the preceding paragraphs shall apply accordingly. In the event of any conflict between these conditions, the consumer may always rely on the provision most favourable to them.
ARTICLE 4: THE OFFER
If an offer is valid for a limited period or subject to specific conditions, this will be stated explicitly.
The offer will include a complete and accurate description of the products and/or services offered. This description will be sufficiently detailed to enable the consumer to make a proper assessment of the offer.
If the merchant uses images, these will be a faithful representation of the products and/or services offered. However, the merchant cannot be held liable for obvious errors in the offer.
Each offer will specify the rights and obligations attached to its acceptance, including:
- The price, including taxes;
- Any delivery costs;
- The manner in which the contract will be concluded and the steps required to do so;
- Whether or not the right of withdrawal applies;
- The terms of payment, delivery and performance of the contract;
- The period for which the offer is valid or the period during which the price is guaranteed;
- Any costs of using a means of distance communication, where these differ from the basic rate;
- How the contract will be archived and how the consumer can access it;
- How the consumer can check and correct the information provided before the contract is concluded;
- The languages available for concluding the contract, in addition to French;
- The codes of conduct to which the merchant is subject and how the consumer can access them electronically;
- The minimum duration of the contract in the case of a continuous or recurring supply of products or services.
